The sum of 50,000.00 is set aside for the 2006 year of this program. Additional funds will be added by vote of the APERC Board of Directors and as are available from year to year. |

| 2. |
The
old regulator replaced must be: |
| |
A. |
For an existing residential customer and used in a residential application. Not for a new customer or a new or replacement tank set. |
| |
B. |
15 years old or older and in service at the time of replacement. |
| |
C. |
A single stage regulator in a single stage regulator system regardless of age. |
| |
|
|
| 3. |
The
replacement regulator must be: |
| |
A. |
A new and never previously used LPG regulator, either a 2nd stage in a two stage system (containing both first and second stage regulators) or a twin stage in a single regulator system. |
| |
B. |
Installed by a duly and currently licensed LPG installer, not the customer. |
| |
C. |
Purchased and installed by the LP dealer at the dealer's expense. |
| |

| 4. |
The
LP dealer will provide the following information on
forms prescribed by APERC that will contain the following
information: |
| |
A. |
The
brand of the replaced (old) regulator and the model
number. |
| |
B. |
The
date code of the replaced (old) regulator |
| |
C. |
The
name, address and telephone number of the customer for
whom the regulator was replaced. (for spot verification
purposes) |
| |
D. |
A
copy of the Arkansas Form LPG 61 (Installation Report)
properly filled out and signed by the customer and the
installer when the replacement was performed. |

E. |
The
name and LPG number of the installer. |
| |
F. |
The
name, address and telephone number of the LP dealer
under whom the installer works and who is requesting
the rebate. |
| |
G. |
A
statement from the requesting dealer that all requirements
of the regulator rebate program and all rules were met
and complied with. |
| |
|
|
| 5. |
The program will begin January 1, 2006 and any replacement request or LPG installation report dated prior to that date will not be considered and will be denied as not timely pursuant to the rules and no rebate will be made. |

| 6. |
The replacement program is limited to one rebate per existing customer regardless of how many regulators are replaced at that one customer's location during the first rebate period of between January 1 and June 30 of each year. |

| 7. |
Each Class One dealer in the State of Arkansas may apply for ten (10) regulator rebates between January 1 and June 30 of each year. Beginning July 1, each Class One dealer may apply as many times as he or she desires. In all cases, when the total of the allotted rebate fund for that year is exhausted, all rebates thereafter will be denied for lack of funds. There will be no request carry over from year to year. Funds not paid out as rebates will be carried over and added to the next year's total. The program for each year will end when all funds are exhausted and the earlier request will be paid first. |

| 8. |
Requests for rebates will be made on forms prescribed by APERC and will be accompanied by all required documentation and if an application is incomplete for any reason, same will not be considered and will be denied with no notice to the requesting dealer. |

| 9. |
Replaced regulators will NOT be sent to APERC or to the Arkansas Propane Gas Association but will be disposed of properly by the LP dealer. |

|
| 10. |
